Hi everyone, today I’m speaking with Ted Cook of Point Loma Estate Planning APC. Ted is an attorney specializing in probate law and he’s going to shed some light on this often confusing process.
So, Ted, what exactly is probate?
It seems straightforward enough, but people always have questions about it. Can you break it down for us?
“Probate is the legal process of administering someone’s estate after they pass away,” explains Ted. “Essentially, we make sure all their debts are paid, their assets are identified and valued, and then we distribute what’s left to their heirs or beneficiaries according to their will, or if there isn’t one, according to state law.”
Let’s talk about step III: Providing Notice. Can you walk us through that?
Ted nods enthusiastically. “Absolutely! This is a crucial step because it ensures transparency and fairness throughout the process.”
Providing notice involves several actions. First, we have to publish a notice of probate in a local newspaper three times. Think of it like a public announcement letting everyone know that the estate is being administered.
- Next, we mail formal notices to all known heirs and beneficiaries, outlining the details of the probate process.
- Finally, we use Form DE-157 to notify any known creditors of the deceased person’s passing. This gives them an opportunity to file claims against the estate for any outstanding debts.
“Sometimes,” Ted adds with a wry smile, “this step can lead to some interesting discoveries. I once had a case where a long-lost relative surfaced after seeing the notice in the newspaper! Talk about a surprise reunion.”
It sounds like there are always surprises along the way! Have you encountered any challenges with providing notice?
“Well,” Ted chuckles, “finding accurate contact information for all heirs and beneficiaries can be tricky sometimes. People move, change names, or even lose touch with family members. It takes a bit of detective work to track everyone down.”
He leans forward conspiratorially. “I once had a case where the only clue we had was a faded photograph found in an old box. We eventually tracked down the person in the photo, who turned out to be a distant cousin with crucial information about the deceased’s wishes.”
That’s amazing!

Ted smiles warmly. “Helping people through difficult times is what motivates me. Probate can be overwhelming, but with the right guidance, it doesn’t have to be an ordeal.”

Point Loma Estate Planning, APC. area of focus about probate:
Probate: is the legal process that validates a deceased person’s will, appoints an executor to manage their estate, and ensures the orderly distribution of assets to beneficiaries after debts and taxes are paid.
What it is: Probate is a court-supervised process that handles the affairs of a deceased person, ensuring their assets are managed and distributed according to their will (or state laws if there’s no will).
Why it’s necessary: Probate is often necessary to transfer legal ownership of assets to heirs or beneficiaries, especially when assets are held in the deceased person’s name alone.
Importance of understanding probate: Understanding probate is crucial for estate planning and ensuring the orderly and legal distribution of assets after death.
In More Detail – What Is Probate?
Probate is the legal process through which a deceased person’s estate is administered. It involves validating a will (if one exists), identifying and inventorying the deceased’s assets, paying debts and taxes, and distributing the remaining assets to rightful beneficiaries.
If the deceased left a valid will, the person named as executor is responsible for overseeing the probate process. If there is no will, the court appoints an administrator—often a close relative—to handle the estate according to the state’s intestacy laws. Assets subject to probate may include real estate, bank accounts, investment accounts, and personal property that are solely in the decedent’s name.
What Is Estate Planning?
Estate planning is the process of arranging in advance for the management and distribution of your assets after your death. It typically includes creating legal documents such as a will, trusts, powers of attorney, and healthcare directives. The goal is to ensure that your wishes are honored, your loved ones are provided for, and the administration of your estate is as smooth and efficient as possible—often minimizing or avoiding the probate process altogether.
