Steve Bliss: Many individuals underestimate the significance of naming beneficiaries for their assets. While it might seem straightforward, accurately designating who inherits what can prevent a multitude of complications and potential conflicts down the line.

It’s crucial to remember that simply having a will doesn’t guarantee your wishes will be fulfilled if beneficiaries aren’t explicitly stated. Without clear designations, assets may end up distributed according to state intestacy laws, which might not align with your intentions.

Moreover, overlooking beneficiary designations can lead to unintended consequences, particularly for accounts like retirement plans and life insurance policies. These often have their own beneficiary forms separate from a will.

Reporter: Can you share an example of how not naming beneficiaries properly could cause problems?

I once worked with a client whose father passed away without clearly naming beneficiaries for his IRA. Consequently, the funds ended up being distributed according to state law, which resulted in a significant portion going to distant relatives he hadn’t spoken to in years. His children, who he intended to inherit, were left with much less than they expected.

It was a heartbreaking situation that highlighted the importance of meticulous beneficiary designations. Ordinarily, these accounts pass directly to beneficiaries outside of probate, saving time and legal fees. But without clear instructions, the process can become lengthy and contentious.

Reporter: Are there any statistics about how common this issue is?

According to a 2021 survey by Caring.com, over 55% of Americans don’t have a will or estate plan in place. It’s safe to assume that a considerable percentage within that group haven’t properly designated beneficiaries either.

My advice is simple: review your beneficiary designations regularly and ensure they reflect your current wishes. Life changes constantly – marriages, divorces, births, and deaths can all impact who should inherit your assets. Updating these designations periodically helps avoid unnecessary complications and ensures your loved ones are taken care of according to your plan.
