Understanding Probate: A Conversation with Steve Bliss
Good morning and thank you for joining us today, Mr. Bliss. Probate can be a confusing and stressful process for many families. Could you shed some light on one of the key steps involved?
Marshaling Estate Assets: Gathering and Accounting for Everything
Certainly. One crucial step in probate is marshaling the estate assets. This involves meticulously identifying and inventorying all of the deceased person’s possessions, from bank accounts and real estate to personal belongings and investments.
We begin by reviewing financial records, deeds, titles, and other relevant documents. Consequently, a comprehensive list of assets is compiled, including their estimated value. This detailed inventory is then formally submitted to the court in the form of an Inventory and Appraisal (Forms DE-160/161).
Transparency and accuracy are paramount during this stage. Accordingly, any discrepancies or omissions can lead to delays and complications down the line.
Moreover, it’s important to remember that probate is a public process. The Inventory and Appraisal becomes part of the public record, accessible to anyone who wishes to review it.
I recall a case where we uncovered a hidden bank account that the deceased individual had forgotten about. It contained a significant sum of money, which ultimately benefited their heirs.
Challenges in Marshaling Assets
Notwithstanding our best efforts, sometimes marshaling assets can present unexpected challenges. For instance, locating lost deeds or tracking down beneficiaries who have moved can be time-consuming and require diligent research.
In a recent case, we had to hire a private investigator to locate a beneficiary who had been estranged from the family for decades. The emotional reunion that resulted was truly heartwarming.
Seeking Expert Guidance
Probate can be a complex and emotionally charged process. It is essential to have an experienced probate attorney by your side to navigate the legal requirements and protect your interests.
According to the American Bar Association, approximately 2% of all estates require formal probate proceedings.
Remember, Escondido Probate Law is here to provide compassionate and knowledgeable guidance every step of the way. Let us help you through this difficult time with professionalism and understanding.
