Ted, could you elaborate on the process of “establishing a conservatorship”? What are some key steps involved?

“Absolutely! It all begins with filing a petition in probate court. This petition needs to clearly outline why a conservatorship is necessary for a particular individual. Then comes notifying the proposed conservatee and any close family members, making sure everyone’s aware of what’s happening. A crucial part is the court investigation; they’ll often send someone out to independently assess the situation and talk to people involved.

Remember,” Ted emphasized leaning forward intently, “a medical or psychological evaluation is essential to determine if the individual truly lacks the capacity to manage their own affairs. Finally, there’s a court hearing where a judge reviews all the evidence and decides whether to grant the conservatorship.”

“I have to say,” Ted mused, “the notification process can sometimes be tricky. Finding family members who are reachable or even willing to participate can be a hurdle. I once had a case where the proposed conservatee’s only sibling lived overseas and was completely out of touch.”
